1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the Website and any purchases made through it. By accessing or using any part of our site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please refrain from using the Website.
2. Eligibility and Account Registration
- You must be at least 18 years old or the age of majority in your jurisdiction and legally competent to contract. By using the Website, you represent that you meet these requirements or have obtained the consent of your legal guardian.
- You agree to provide true, accurate and complete information during registration and to update it as necessary.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorised access.
3. Orders, Pricing and Payments
- All orders are subject to acceptance and product availability. We may cancel or refuse any order if a product is unavailable or if we suspect fraud or misuse.
- Payment methods include secure online payments, credit/ debit cards, digital wallets and other options displayed at checkout. All payments must be made in Indian Rupees. Prices displayed on product pages are inclusive of taxes where required, and we will clearly disclose any additional charges for shipping or optional services before you confirm your order. We do not impose hidden fees or engage in “drip pricing” practices.
- We do not add items to your cart without your express consent. You will have the opportunity to review and modify your order before payment is finalised.
- You will receive an order confirmation email once your order has been successfully placed. Acceptance of your order occurs when we dispatch the product.
- In accordance with the Consumer Protection (E‑Commerce) Rules, we will not charge cancellation fees unless similar charges are borne by us for cancellation. Refunds, when applicable, will be processed using the original payment method and will be completed within the timeframe prescribed by the Reserve Bank of India or other applicable regulations.
4. Product Information and Legal Metrology Compliance
- We strive to provide accurate descriptions, images and specifications for products. However, we cannot guarantee that your device’s display will reflect colours perfectly.
- In accordance with the Legal Metrology (Packaged Commodities) Rules 2011, product pages for pre‑packaged goods will display the manufacturer’s name and address, country of origin, common or generic name of the product, net quantity, maximum retail price (MRP), best‑before or use‑by date and other mandatory declarations. Sellers are responsible for the accuracy of these declarations; we may delist products that do not comply.
- Any special claims (e.g., “organic”, “handmade” or “authentic”) must be supported by the seller. We prohibit misleading advertisements and false claims in accordance with the Consumer Protection Act and CCPA guidelines.
5. Discounts, Promotions and Flash Sales
- We occasionally offer discounts or promotions. All promotional offers will be transparent and clearly described. We will not employ deceptive practices such as fake flash sales, false urgency or bait‑and‑switch tactics.
- Some discounts may require you to enter a coupon code or meet specific criteria (e.g., minimum purchase value). Unless otherwise stated, discounts cannot be combined with other offers.
6. Shipping and Delivery
- Delivery timelines depend on product availability, destination and the logistics partner. Estimated delivery times will be displayed at checkout. We are not liable for delays caused by logistics providers or events beyond our control.
- Shipping charges (including handling and packaging, if any) will be disclosed before you finalise your order. Additional shipping fees may apply for remote locations or oversized items.
- Title and risk of loss for products purchased pass to you upon delivery. If you believe your package has been tampered with, please contact us immediately.
7. Returns, Refunds and Cancellations
- You may cancel your order before it is dispatched at no cost. After dispatch, cancellation may not be possible depending on the product type.
- We accept returns for defective, damaged or incorrect products. To be eligible, you must notify us within the return window specified on the product page (generally seven days) and provide evidence of the issue. Products must be unused and in original packaging.
- Some products—such as perishable goods, personalised items or intimate wear—are non‑returnable unless they arrive damaged or defective.
- Refunds will be processed after we receive and inspect the returned product. Refunds may be provided as store credit or to the original payment method, at our discretion .
8. User Content and Reviews
We welcome reviews, comments and other content from users. You agree that your submissions will not violate any law or infringe the rights of others. You grant us a non‑exclusive, royalty‑free licence to use, reproduce, modify, adapt, publish and display such content in connection with our business. We may moderate, edit or remove user content that we consider unlawful, offensive or otherwise inappropriate. You alone are responsible for your posts and any harm resulting from them.
9. Intellectual Property
All content on the Website—including text, graphics, photographs, logos, audio, video and software—is owned by or licensed to Trend In Need and protected by intellectual property laws. You may not copy, modify, reproduce, display, distribute or otherwise exploit any content without our prior written consent.
10. Prohibited Activities
You agree not to use the Website for any unlawful or fraudulent purpose or engage in activities that violate these Terms or infringe upon the rights of others. Prohibited activities include, but are not limited to:
- Violating any applicable law or regulation, including intellectual property, defamation and privacy laws.
- Uploading or transmitting viruses, malware or any code designed to disrupt the Website’s operation.
- Using bots, scripts or other automated means to access the Website without our permission.
- Misrepresenting your identity or impersonating another person or entity.
- Engaging in unfair trade practices or dark patterns, including false urgency, basket sneaking, confirm shaming or any other deceptive UI design.
11. Limitation of Liability
To the fullest extent permitted by law, Trend In Need and its affiliates, directors, officers and employees shall not be liable for any indirect, incidental, special or consequential damages arising out of your use of the Website, including lost profits, loss of data or other intangible losses. Our total liability for any claim arising from your use of the Website or purchase of products will not exceed the amount paid by you for the relevant products.
12. Indemnification
You agree to indemnify and hold harmless Trend In Need, its affiliates and their respective directors, officers, employees and agents from any claims, damages, liabilities and expenses (including attorneys’ fees) arising out of your use of the Website, breach of these Terms or violation of any rights of a third party.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms, your use of the Website or purchase of products shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India. You may also seek redress through the consumer dispute redressal commissions established under the Consumer Protection Act 2019.
14. Changes to these Terms
We may update these Terms at any time. Changes will be posted on this page, and the “Effective Date” above will reflect the date of the latest update. Continued use of the Website after changes constitutes acceptance of the revised Terms.
15. Compliance with Dark Pattern Regulations
We are committed to ethical design and marketing. We have adopted processes to identify and eliminate dark patterns from our platform. In line with the CCPA’s 2023 Guidelines and 2025 advisory, we conduct regular self‑audits and training for our team to ensure that we do not deploy deceptive design practices.
